This Privacy Policy applies to information we collect about users of the Emigo container website (https://emigotek.com), Emigo container mobile app, and Emigo container internet-connected products (e.g., mugs, accessories).

We collectively refer to the aforementioned website, mobile app, internet-connected products, and their associated services as the “Services.”

THE INFORMATION WE COLLECT

We obtain a variety of information from and about you as you use the Services. Please note that we need certain types of information so that we can provide the Services to you. If you do not provide us with certain information, or ask us to delete it, you may no longer be able to access or use our Services. For example, if you are a customer but do not provide us with your billing information, we won’t be able to fulfill your orders.

Information You Provide to Us

Emigo container collects information directly from you through your use of our Services. For example:

Our company will collect your information in the following scenarios, and all information is provided voluntarily by you:

  1. Account Management Scenario: During the process of your account registration and subsequent account management
  2. Order Processing Scenario: During the process of us handling your orders and completing order delivery for you
  3. Communication and Interaction Scenario: When you conduct business transactions with our company (including via the official website, online chat function, mobile application, third-party social media platforms, as well as email, letter, and other methods)

  6. Job Application Scenario: When you submit a job application through the official website

The information collected by our company mainly includes the following categories:

  • Basic Information: Name, account login information (including password and email), contact information (including address and phone number)
  • Consumption-Related Information: Billing information, payment information, order details, customer service communication records
  • Job Application-Related Information: If you apply for a position, our company will collect your name, email address, cover letter, personal resume (CV), and LinkedIn account information

You may also submit, post, upload, or otherwise make available (collectively, “Post”) certain content through our Services. For example, you may Post reviews, ratings, pictures, and other content such as videos, questions, comments, ideas, designs, features, plans, and other feedback (collectively, “User Content”). User Content may be publicly viewable by other users. For example, if you post a rating or review, then that rating or review will be displayed along with your name and geographic location, if you choose to provide such information. Please review our Terms of Service for more information about our rights with regard to your User Content.

If you request that your Emigo container purchase be shipped to someone other than yourself (such as a gift recipient), we use the information you provide about the other person to fulfill the shipment.

Information We Collect Through Automated Means

When you use our Services or connect your Emigo container product to our Services, we collect certain information automatically as described in this section. We and our service providers (which are third-party companies that work on our behalf) may use a variety of technologies, including cookies and similar tools, to assist in collecting this information. You can learn more about our use of cookies and similar tools in the “Cookies and Similar Technologies” section below.

Website. When you use our website, we collect and analyze information such as your IP address, browser characteristics, device IDs and characteristics, operating system, the state or country from which you accessed the Services,  referring and exit pages and URLs, platform type, the number of clicks, files you download, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time you used the Services and upload or post content, error logs, language preferences, and other similar information.

Mobile App. When you use our mobile app, we and our service providers automatically receive certain information about the mobile phone, tablet, or computer used to access the app, including a mobile device identifier, IP address, operating system, version, whether and when you update the app and your connected Ember products, date and time of use, duration of use, and how you use the app. We also collect data through the mobile app that is generated from use of the Emigo container product, such as product settings, preferred warm beverage types, temperatures, and consumption patterns including caffeine intake.

01.Diagnostic and Usage Information:

Our service providers may collect diagnostic and usage information from the mobile app, and combine it with information about your past online activities (including usage of other devices, websites, or apps, if the relevant services use the same vendors). If you wish to opt out of such information sharing, please refer to the "Privacy Policy & Settings" menu in the mobile app.

02.Location Information:

When you use our Services, we and our service providers will collect general location information from your computer or mobile device. This information identifies the city and state where your device is located based on its IP address, and helps you access content customized to your general location.

Precise GPS Location Information We will ask for your permission before collecting your precise GPS location. This information is used to provide customized services, content, promotional offers, and other relevant information. You can disable geo-location tracking on your device. For details, see the “Data Subject Rights and Your Marketing Choices” section below. Information from Other Content Providers or Social Media Platforms If you connect your Emigo container product to providers like Google Assistant/Apple Siri or social media platforms (e.g., via social log-in), these providers will let us and our service providers access and store information about your interactions related to our Services (e.g., when you clicked the Google Assist/Siri button). To avoid this sharing, do not set up such connections. If you “like”/“follow” us on Facebook, Instagram, Twitter, etc., or sign up for our promotions/submit info via social media, we may collect your name, email, and relevant comments/content you post.

Information We Collect from Others

We may also receive additional information, such as demographic and statistical information, from third parties, such as business partners, marketers, researchers, analysts, and other parties that we may attribute to you based on your assignment to certain statistical groups.

We and our service providers mainly use the aforementioned information for the following business and operational purposes:

  • Account Management: Processing account registration and verifying your information
  • Service Provision and Optimization: Providing, managing, and improving services (including order fulfillment); sending updates and information related to your orders/purchases
  • Customer Support: Responding to your inquiries and providing more efficient customer service through interactive chat functions and other channels
  • Internal Business Operations: Supporting service-related activities such as auditing, security protection, troubleshooting, fraud prevention, billing and financial accounting, marketing and promotion, data analysis, and research and development
  • Job Application Processing: Reviewing and processing job applications
  • Communication and Outreach: Contacting you regarding Emigo containers, third-party products/services, surveys, promotional activities, and other topics that may be of interest to you
  • Content and Advertising Customization: Personalizing content, preference settings, and advertisements within our Services and on other platforms
  • Compliance and Rights Protection: Complying with laws, regulations, and other legal procedures; claiming, exercising, or defending our legitimate legal rights; taking reasonably necessary measures to protect the safety, security, and rights of Emigo Containers, its employees, service providers, and other relevant parties

  • We may combine the information collected through this Service with information collected automatically or obtained from other sources, and use such combined information in accordance with this Privacy Policy.
  • We may aggregate, de-identify, and/or anonymize the collected information in a manner that prevents reasonable association with you or your device. Such information may be used for any purpose, including but not limited to research and marketing purposes.

Legal Bases for the Use of Your Information

Some countries require that enterprises may only process your "Personal Data" (as defined in the EU General Data Protection Regulation) when they have a "legal basis" (or reasonable necessity) for doing so. To the extent that these laws apply, our legal bases for processing Personal Data are as follows:

  • Contract Performance Requirement: Processing your Personal Data is a necessary step to fulfill the obligations under the contract (or pending contract) with you. For example, we will process the relevant Personal Data to enter into a contract with you in compliance with the Terms of Service and to fulfill the commitments agreed in any contracts we have with you.
  • Legitimate Interest Requirement: Processing your Personal Data is a necessary step to safeguard our legitimate interests or the legitimate interests of others. For example: operating the business and our Services; identifying and fixing any issues with our Services; ensuring the security of our Services; understanding customers' usage habits; conducting internal analysis and research related to the Services; improving the Services and users' experience with the Services; testing and developing new Services; sending information about new products, preferential offers or other content that may be of interest to you to the email address you provided; ensuring a safe environment for our employees; processing payments and receipts; complying with legal requirements and safeguarding our legitimate legal rights; preventing fraud; and confirming the identity of the customer who receives our Services.

COOKIES AND SIMILAR TECHNOLOGIES

To collect the information in the “Information We Automatically Collect” section above, we and our service providers use Internet server logs, cookies, tags, tracking pixels, and other similar tracking technologies. We use these technologies in order to offer you a more tailored experience in the future by understanding and remembering your particular browsing preferences.

A web server log is a file where website activity is stored.

ONLINE ANALYTICS AND ADVERTISING

Analytics

Third-Party Web Analytics Services:

We may use third-party web analytics services (such as Google Analytics) in our Services. These services collect and analyze usage information through cookies and similar tools, which are used for auditing, research, reporting, fraud prevention, and providing specific features to you. If you wish to prevent Google Analytics from using your information, you may click here to install the "Google Analytics Opt-out Browser Add-on".

Email Analytics Tools:

If you receive emails from us, we may use analytics tools such as tracking pixels to capture data, including when you open our messages and when you click on any links or banners contained in our emails. This data helps us evaluate the effectiveness of our communications and marketing campaigns.

Online Advertising Third-Party Advertising Technologies Our Services may allow third-party advertising technologies (e.g., ad networks like Google Display Network, Criteo) to place cookies or other tracking technologies on your device (computer, mobile phone, etc.). These technologies collect your information to deliver relevant ads—both on our Services and on other websites/services you use. Ads may be based on your real-time activity, historical activity across platforms, and tailored to your interests. Customer Information for Targeted Ads We sometimes share customer information (e.g., email addresses) with service providers. These providers will match this information in de-identified form to cookies, mobile ad identifiers, or other proprietary IDs, to deliver more relevant ads to you on other websites and mobile apps. Control Over Third-Party Tracking We have no access to the cookies/tracking technologies placed by these non-affiliated third parties, and this Privacy Policy does not govern them. To manage tailored browser advertising or control such cookies: Visit the Network Advertising Initiative’s Consumer Opt-Out link, Digital Advertising Alliance’s Consumer Opt-Out link, or Your Online Choices to opt out of tailored ads from participating companies. Note: Opt-outs apply per device—you need to opt out for each device used to access our Services.

Notice Concerning Do Not Track.

Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. We are committed to providing you with meaningful choices about the information collected on our website for third-party purposes, which is why we describe a variety of opt-out mechanisms above. ONLINE ADVERTISING

We may, on occasion, share customer information (e.g., email addresses) with our service providers. We do not have access to the cookies or tracking tools placed by these non-affiliated third parties, nor does this Privacy Policy govern such cookies or tools. To manage tailored browser advertisements or exercise control over such cookies, you may take the following actions:

Note: Opt-out settings apply on a per-device basis—you are required to complete the opt-out process for each device used to access our Services.

RETENTION OF YOUR INFORMATION

We keep your information for no longer than necessary for the purposes for which it is processed. The length of time for which we retain information depends on the purposes for which we collected and use it and/or as required to comply with applicable laws.

THIRD-PARTY LINKS AND FEATURES

The Services contain links to third-party websites, third-party plug-ins (e.g., Facebook, Pinterest, LinkedIn, and Twitter), or allow you to integrate with third-party services and apps (e.g., Apple Inc.’s Health app). If you choose to use these websites, plug-ins, or services, you may disclose your information not just to those third parties, but also to their users and the public more generally depending on how their services function. Similarly, if you use a third-party app that works in connection with your Ember product, you acknowledge that information may be shared with the third-party app during the connection that is necessary for the connection to function (e.g., information about how you use your Emigo container product). If you choose to use these services and initiate these connections, Ember is not responsible for the content or practices of such third-party websites or services. The collection, use, and disclosure of your information will be subject to the privacy policies of the third-party websites or services, and not this Privacy Policy. We urge you to read the privacy and security policies of these third parties.

YOUR PRIVACY RIGHTS REGARDING YOUR INFORMATION

Your local laws (such as those in the European Union, California, or Nevada) may permit you to exercise certain rights with respect to the information we collect from and about you.  For more information about these rights, whether they apply to you, and how to exercise them, please visit emigotek.com

MARKETING CHOICES

If we are legally permitted to send you marketing communications in your jurisdiction (based on our relationship with you, your consent, or applicable law), you may instruct us not to use your contact information to contact you by email, postal mail, or phone regarding products, services, promotions and special events that might appeal to your interests by contacting us using the information below. In commercial email messages, you can also opt-out by following the instructions located at the bottom of such emails. Please note that, regardless of your request, we may still use and share certain information as permitted by this Privacy Policy or as required by applicable law. For example, you may not opt-out of certain operational emails, such as those reflecting our relationship or transactions with you.

CHILDREN’S PRIVACY

Our Services are intended for general audiences and not for children.
If we become aware that we have collected "personal information" (as defined by the U.S. Children’s Online Privacy Protection Act) from children under the age of 13, or processed Personal Data of EU residents under the age of 16, without parental consent, we will take reasonable steps to delete such information/data as soon as possible.
We also comply with other age-related restrictions and requirements under applicable local laws. 

INTERNATIONAL USERS

When providing services to you, Emigotek may, in accordance with applicable laws, subcontract the processing of your data to, or share your data with, the following entities: Emigotek affiliates and subsidiaries, trusted service providers, and trusted business partners. These entities may be located outside your country of residence, including in the United States and Canada.
The aforementioned third parties are primarily responsible for providing services to you, processing transactions, or delivering support services.
By providing your information to us, you acknowledge such transfer, storage, or use of your data.

If you reside in the EEA, please note: When we share your information with non-EEA Emigotek affiliates/subsidiaries or third-party data processors, we will take appropriate measures to ensure these entities protect your information in line with this Privacy Policy. Such measures include signing Standard Contractual Clauses (in compliance with EU and other data protection laws) to regulate data transfers. For more details on these transfer mechanisms, please contact us as specified in the "Contact Information" section below. If applicable, you may file a complaint with the data protection supervisory authority in your country of residence. Alternatively, if you believe your rights have been violated, you may seek redress through local courts.

EMPLOYMENT APPLICATIONS

1、Greenhouse-Administered Employment Services

Our Services may include a careers section for applying to Ember. These employment services are not hosted by Emigotek, but administered by our service provider Greenhouse Software, Inc. (“Greenhouse”).​

  • Greenhouse collects information (e.g., your contact details, job qualifications) and uses cookies/other tools to collect data—solely for analytics and enabling you to complete your application.​
  • Any information Ember obtains from Greenhouse regarding your Emigotek job application is handled per this Privacy Policy. Ember will use/share this information only for employment purposes (e.g., evaluating your job fit, communicating with you about your interests) or as required by law.​
  • Emigotek has an agreement with Greenhouse governing employment application data processing: Greenhouse may only access/use/share your information to fulfill Ember’s directed functions, and must comply with EU-approved standard contractual clauses for EU residents’ applicant data.​
  • For questions about your employment application data handling, contact us via the “Contact Information” section below.​
  • Applications via LinkedIn or Other Platforms

You may also connect to LinkedIn or other websites to apply for Emigotek roles. Any information Emigotek collects from these platforms for your application is handled per this Privacy Policy.​

Emigotek will use/share this information only for employment purposes (e.g., evaluating your job fit, communicating with you about your interests) or as required by law.

CHANGES TO OUR PRIVACY POLICY
